Acceptance and the service
By using Take The Top or purchasing a level, you agree to these Terms of Use and the Community Rules. Take The Top is a public digital tower where verified purchases create new contributor levels. It is not an investment, auction, advertising campaign, traffic guarantee, or endorsement service.
We may update the service or these terms as it evolves. The version posted here applies from its stated update date. Your continued use after an update means you accept the updated terms, to the extent allowed by law.
Who may purchase
You must be legally able to enter this agreement. If you submit a level for a business or another person, you confirm that you are authorized to act for them. You are responsible for the accuracy and legality of the information you submit.
Reservations, payments, and fulfillment
The site may temporarily reserve the next level while you check out. A reservation can expire and is not a completed purchase or a permanent claim. Payments are processed by Stripe. The price, currency, and available payment methods are shown before you pay.
Your purchase is fulfilled only after we receive verified confirmation of payment from Stripe. At that point, the submitted contribution is added as a public level. Payment processing delays, failed payment attempts, expired reservations, or a page closing before confirmation do not create a right to a level.
Except where applicable law requires otherwise, payments are final once the public level has been created. Later levels may surpass yours, and changes in visibility, traffic, business results, or your preferences do not by themselves make a purchase refundable.
Your content and license
You retain any rights you have in your submitted content. You grant Take The Top a worldwide, non-exclusive, royalty-free license to display, reproduce, format, store, promote, and archive that content as needed to operate and present the tower. This license continues for as long as the level or its necessary records remain available.
You promise that your submission and linked destination comply with the Community Rules, do not violate another party’s rights, and do not contain malicious code or deceptive material. We may decline, hide, edit, or remove content or links under the Community Rules without assuming an obligation to monitor every submission.
Availability, no endorsement, and limits
We aim to keep the tower available and accurate, but the service is provided on an as available basis. We do not promise uninterrupted operation, error-free display, preservation against every technical event, or any commercial result from a level. A public placement does not mean that we endorse, verify, or recommend its contributor or linked website.
To the maximum extent allowed by law, Take The Top is not liable for indirect, incidental, special, consequential, or punitive damages arising from the service. Where liability cannot be excluded, it is limited to the amount you paid for the specific level giving rise to the claim. Nothing in these terms limits rights that cannot legally be waived.
Your responsibility
You will defend and indemnify Take The Top and its operators against claims, losses, and reasonable costs arising from your submission, linked website, misuse of the service, or violation of these terms, except to the extent caused by our own misconduct.
